These Terms of Use (“Terms”) govern your access to and use of the website, programs, services, applications, events, and communications of the Good Life Education & Empowerment Foundation, Inc. (“Foundation,” “we,” “our,” or “us”). By accessing our website at www.gleef.org, making a donation, submitting an application, registering for an event, or otherwise engaging with the Foundation, you agree to be bound by these Terms.

1. Website Use

You agree to use this website only for lawful purposes consistent with the Foundation’s charitable mission. You may not damage, disable, overburden, or impair our systems; interfere with any other party’s use of the website; attempt unauthorized access to any portion of the website; transmit malicious code, viruses, or harmful content; or scrape, harvest, or collect information without written permission. We reserve the right to suspend, restrict, or terminate website access at our discretion.

2. Donations and Refund Policy

All donations to the Foundation are voluntary and gratefully received. The Foundation is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, and contributions are tax-deductible to the extent permitted by law.

Because charitable contributions are generally non-refundable, refund requests are reviewed on a case-by-case basis and must be submitted in writing to admin@gleef.org within fifteen (15) days of the original transaction. Refunds, when issued, will be returned to the original payment method. Donor-restricted contributions used for stewardship, processing fees, or program disbursement may not be eligible for refund.

3. Scholarship Applications

Scholarship applications must be submitted accurately, truthfully, and on time. The Foundation reserves the right to verify all information submitted, request additional documentation, disqualify applications containing false or incomplete information, and modify, suspend, or discontinue scholarship programs at any time. Submission of an application does not guarantee an award. All scholarship decisions are final.

4. Workforce Development Applications

Applicants to workforce development programs agree to meet attendance, participation, and conduct requirements; complete required assessments and training; and comply with partner employer expectations where applicable. The Foundation may remove participants who fail to meet program standards, engage in disruptive behavior, or violate program policies.

5. Event Registrations

Event registrations are subject to availability, capacity, and Foundation discretion. Tickets, sponsorships, and registration fees are generally non-refundable unless otherwise stated. The Foundation reserves the right to reschedule, relocate, or cancel events. In the event of cancellation, the Foundation will use reasonable efforts to notify registrants and may, at its discretion, offer rescheduling, credit toward future events, or refunds.

6. Volunteer Participation

Volunteers serve at the discretion of the Foundation and must comply with all volunteer guidelines, code of conduct, and safety procedures. Volunteers are not employees and are not entitled to wages, benefits, workers’ compensation, or unemployment benefits. The Foundation reserves the right to decline, reassign, or terminate volunteer service at any time and for any reason.

7. Intellectual Property Rights

All content on this website — including text, graphics, logos, photographs, videos, designs, program materials, curricula, branding, and software — is the property of the Good Life Education & Empowerment Foundation, Inc. or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws. No portion of this website or Foundation materials may be reproduced, distributed, modified, displayed, or used for commercial purposes without prior written consent.

8. User-Generated Content

By submitting content — including testimonials, photos, videos, comments, application materials, stories, or feedback — to the Foundation, you grant the Foundation a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, modify, publish, distribute, and display such content for charitable, educational, fundraising, marketing, and promotional purposes. You represent and warrant that you own or have all necessary rights to the content submitted and that it does not violate any third-party rights.

9. Media Release

By participating in Foundation events, programs, or activities, you consent to being photographed, filmed, recorded, or livestreamed and grant the Foundation the unrestricted right to use your name, likeness, image, voice, and statements in any media, format, or platform now known or hereafter developed, including websites, social media, annual reports, marketing materials, fundraising appeals, and press releases, without compensation. If you do not consent, you must notify the Foundation in writing prior to the event.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Good Life Education & Empowerment Foundation, Inc., its directors, officers, employees, volunteers, partners, sponsors, contractors, and agents from and against any and all claims, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the website, your participation in any Foundation program or event, your violation of these Terms, or your violation of any law or third-party right.

11. Limitation of Liability

To the maximum extent permitted by law, the Foundation and its directors, officers, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the website or participation in any Foundation activity. The website and all programs are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

12. Arbitration and Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms, the website, donations, programs, applications, or any Foundation activity shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall be conducted in the State of Georgia. You waive any right to a jury trial and any right to participate in a class action, consolidated proceeding, or representative action. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to its conflict of law principles. Any action not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of such courts.

14. Accessibility Statement

The Foundation is committed to ensuring digital accessibility for individuals of all abilities. We are continuously working to improve the user experience for everyone and to apply relevant accessibility standards, including, where applicable, the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter an accessibility barrier or require assistance accessing any portion of the website, please contact admin@gleef.org and we will make reasonable efforts to provide the information you need.

15. Copyright Policy

The Foundation respects the intellectual property rights of others and expects users to do the same. If you believe content on our website infringes your copyright, please submit a written notice to admin@gleef.org including (a) a description of the copyrighted work, (b) the URL or location of the alleged infringing material, (c) your contact information, (d) a statement of good-faith belief that the use is not authorized, and (e) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.

16. Trademark Protection

“Good Life Education & Empowerment Foundation,” “GLEEF,” the Foundation’s logo, and related names, marks, designs, and slogans are trademarks of the Foundation. You may not use these marks without prior written permission. All other trademarks appearing on the website are the property of their respective owners.

17. AI and Content Disclaimer

Certain content on the website, in publications, or in communications may be produced, edited, summarized, or assisted by artificial intelligence tools, automated systems, or third-party content providers. While we make reasonable efforts to ensure accuracy, the Foundation does not warrant that all information is current, complete, or free of error. Content is provided for informational and educational purposes only and does not constitute legal, financial, medical, employment, educational, or professional advice.

18. SMS and Email Communication Consent

By providing your phone number or email address, you consent to receive transactional, programmatic, fundraising, event, and informational messages from the Foundation via SMS, MMS, email, or other electronic means. Message and data rates may apply. Frequency of messages may vary. You may opt out of SMS communications at any time by replying “STOP” to any message, and you may opt out of email communications by using the unsubscribe link provided. Opting out of marketing messages does not affect transactional communications such as donation receipts or application confirmations.

19. Fundraising Disclosures

The Foundation conducts charitable fundraising in accordance with applicable federal and state laws. Required state-specific charitable solicitation disclosures are available upon request by contacting admin@gleef.org. A copy of the Foundation’s most recent financial statement and registration filed with applicable state agencies may be obtained as required by law.

20. Recurring Donation Authorization

By enrolling in a recurring giving program, you authorize the Foundation and its payment processor to charge your designated payment method on the recurring frequency you select (monthly, quarterly, or annually) until you cancel. You may modify, pause, or cancel your recurring donation at any time by contacting admin@gleef.org or by managing your donor account. Recurring contributions will continue at the selected amount unless you notify the Foundation in writing.

21. Sponsorship Terms

Corporate, organizational, and individual sponsorships are subject to written sponsorship agreements outlining benefits, recognition, payment terms, and obligations. The Foundation reserves the right to decline or terminate any sponsorship that conflicts with its mission, values, or reputation. Sponsorship recognition does not constitute an endorsement of any sponsor’s products, services, political positions, or business practices by the Foundation.

22. Affiliate and Partner Relationships

The Foundation may collaborate with educational institutions, employers, government agencies, financial institutions, and community organizations to deliver programs and services. Such relationships do not constitute joint ventures, partnerships, agencies, or employment relationships. Each party remains independently responsible for its own conduct, obligations, and legal compliance.

23. Force Majeure

The Foundation shall not be liable for any failure or delay in performance of its obligations resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, severe weather, pandemic or epidemic, public health emergencies, war, terrorism, civil unrest, governmental action, labor disputes, utility outages, internet or telecommunications failures, or cybersecurity incidents.

24. Account Termination Rights

The Foundation reserves the right, in its sole discretion, to suspend or terminate your access to the website, donor account, applicant portal, volunteer profile, program participation, or any other Foundation service at any time, with or without notice, for any reason, including violation of these Terms, conduct inconsistent with the Foundation’s mission, or as required by law. Termination does not relieve you of obligations incurred prior to termination.

25. Changes to These Terms

The Foundation may update these Terms at any time. Updated Terms become effective upon posting to the website. Your continued use of the website or participation in Foundation programs constitutes acceptance of the revised Terms.
